​EQUINE TRAINING AGREEMENT
 
This Agreement is made this__________ day of, 20____  by and between Buddy Uldrikson Horsemanship, hereinafter referred to as "Trainer" and                                                       Owner, herein referred to as "Client" and if Client is a minor, Client's parent or guardian and shall be in effect for a period of  days.

In consideration of the agreement herein set forth, the parties agree to the following terms:

Health Requirements and Coggins Test:

The Client is to provide a Coggins Test with negative results, prior to unloading the horse at Trainer's facility. The Coggins Test must have been performed within the last twelve (12) months.

The Client must provide a Health Certificate by a licensed veterinarian, attesting that said horse is free of infectious or communicable disease.

The Client must provide a health record, including immunization and worming records.
 
Training Fee: (check type):

Full Training at One Thousand One Hundred Dollars ($1,100.00)/month. Must be paid Fifty Percent (50%) in advance of training and Fifty Percent (50%) prior to removing horse from training. Fee includes hay and board, and one (l) one-hour lesson for Client during the course of the training period.

Half Training at Five Hundred Fifty Dollars ($550.00). Must be paid Fifty Percent (50%) in advance of training and Fifty percent (50%) prior to removing horse from training. Fee includes hay and board, and one (1) one-hour lesson for Client during the course of the training period.

Additional Expenses:

Additional costs, including required farrier, dentistry, chiropractic, veterinarian or other equine services shall be from Client's practitioner or from a practitioner available to and selected by the Trainer, and shall be the responsibility of Client.

Special Requirements:

Any special feeds, medicines, or feeding routines may be subject to an administration fee, and the product shall be supplied by the Client.

Client Lessons:

Additional lessons, excluding the one (1) one-hour training lesson, shall be billed to Client at the rate of Seventy-Five Dollars ($75.00) per hour.

Trainer's Duties:

Trainer shall train, feed and care for horse, in a manner consistent with accepted equine practices. Trainer has the discretion to decide what method/style of training and equipment is appropriate, based on the specific horse and intentions of the Client.

Risk of Loss and Standard of Care:

During the time that the horse(s) is/are in custody of Trainer, Trainer shall not be liable for any sickness, disease, estray, theft, death, or injury which may be suffered by the horse(s) or any other cause of action whatsoever, arising out of or being connected in any way with the training of said horse(s), except in the event of gross negligence on the part of the Trainer, its agents, and/or employees. This includes, but is not limited to, any personal injury or disability the Client, or Client's guest, may receive on Trainer's premises.
 
Inherent Risks and Assumption of Risk:

The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as running, bucking, biting, kicking, shying, stumbling, rearing, falling, or stepping on, that may result in any injury, harm, or death to persons on or around them; the unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions, collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant's ability.

The Client fully understands that Trainer does not carry any insurance on any horses not owned by it for training or for any other purposes, whether public liability, accidental injury, theft, or equine mortality insurance and that all risks connected with training or for any other reason for which the horse(s) is in the possession of, and on the premises of Trainer are to be borne by the Client.

The standard of care applicable to Trainer is that of ordinary care of a prudent horse Client and not a compensated bailee. In no event shall Trainer be held liable to Client for equine death or injury. Client agrees to obtain equine insurance for any animals, at Client's expense, or forego any claim for any amount. Client agrees to disclose this entire agreement to Client's insurance company and provide Trainer with the company's name, address, and policy number. Failure to disclose insurance information shall be at the Client's risk.

Hold Harmless:

Client agrees to hold Trainer harmless from any and all claims arising from damage or injury caused by said horse(s) to anyone, and defend Trainer from any such claims. Client agrees to disclose any and all hazardous or dangerous propensities of horse(s) in training with Trainer. Trainer reserves the right to notify Client within seven (7) days of the horse's arrival if said horse, in Trainer's opinion, is dangerous, untrainable, unhealthy, handicapped, or otherwise unfit for training Upon such notification, Client shall remove said horse within seven (7) days, and all expenses incurred for the horse's stay shall be paid prior to departure. Upon payment of all fees, this contract shall be deemed terminated.

Emergency Care:

The Trainer agrees to attempt to contact Client should Trainer determine veterinary treatment is needed for said horse(s), but, if Trainer is unable to contact Client, Trainer is then authorized to secure emergency veterinary, and farrier care required for the health and well-being of said horse(s). All costs of such care secured shall be paid by Client within fifteen (15) days from the date Client receives notice thereof, or Trainer is authorized, as Client's agent, to arrange direct billing to Client.
 
Trainer shall assume that Client desires surgical care if recommended by veterinarian in the event of colic, or other life-threatening illnesses, unless Trainer is instructed herein by Client that the horse(s) is/are not surgical candidates.

Client agrees to notify Trainer of any and all changes of address, emergency telephone numbers, itineraries, or other information reasonably necessary to contact Client in the event of an emergency. In the event Client departs for vacation or is otherwise unavailable, prior to departure, Client shall notify Trainer as to what party is authorized to make decisions in the Client's place with regard to the health, well-being, and/or medical treatment of the horse(s).

Entire Agreement: This Agreement represents the entire agreement between the parties. No other agreements, promises, or representations, verbal or implied, are included herein unless specifically stated in this written agreement. This Agreement is governed by the State of Arizona and it is intended to be as broad and inclusive as is permitted by Arizona law, and that in the event any portion of this Agreement is determined to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.
